Ironically, it is the law & order types who dream of technology that can read people's minds and discover criminal intent. They love good old torture for the same reason: They think it exposes the inner thoughts and intent of criminals and terrorists. But the idea that the same logic might be applied to them has them pissing in their Depends, the old fools.

In America, we insist on the absolute freedom to think anything you want. We defend the right of free expression to the death, from avant garde art to rebellious polemics, from nude dancing to Ku Klux Klan rallies. There is no such thing as "hate speech" in the law here. Hate all you want in the good old USA. As long as you don't act or incite others to act criminally, it's all good. But once you do commit a criminal act, your intent becomes a matter of interest under the law. Under the new hate crimes legislation passed by the US House of Representatives, those who commit crimes motivated by hatred and prejudice against real or perceived groups will find judges and juries most attentive to the messages they were trying to send by committing their crimes. As well they should.

"Intent" is always considered in criminal cases. That's the difference between First and Second Degree Murder, and between Murder and Manslaughter, or Manslaughter and Accidental Death: Did the accused mean to kill? What was his or her state of mind? Was he or she drunk, high, crazy, terrified? Did they act "with malice aforethought"? Did they show any remorse, or did they try to cover up their crime? Do they show remorse now? Is it genuine?

These are the kinds of questions we ask judges and juries to decide. That's why they're there: To exercise their judgment, and try to understand the motivations of an accused person. Maybe they killed in self-defense, or by accident. Maybe they killed for money, or to cover up a crime. Motive matters.

The fact is, it's the perpetrators themselves who have created this special class of crime. The new law simply recognizes an old fact. In many cases, the perpetrators have no connection to their victims, don't even know them, had no reason to do anything to them, not even robbery. They chose to make a statement of their ideas, attitudes or feelings about another "kind" of person or perceived group of persons by committing what is, in any circumstances, a crime against them. They committed a crime against another person BECAUSE of that persons' actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity, or disability.

Who and what the victim was provided the motivation for a criminal act. The perpetrator chose to break the law for the purpose of striking out against a whole group of people, an act of extraordinary anti-socialism. They chose to use crime to make a statement to all of society, to hurt and terrorize an entire class of human beings. They chose to move from thought to action, from thinking to doing, from abstract to concrete, from ideal to real. They forced this issue by moving beyond symbolism to actual crime. The new law does not criminalize thought, nor does it criminalize behavior that was not already criminal under the law: Assault, battery, rape, murder, arson, and other crimes of violence with intent to cause bodily injury: Crimes without a doubt, since time immemorial.

Under all of our laws, once a crime is proved, the punishment must always hinge on intent. We've already singled out for special punishment our convicted cop-killers, kiddie-porn producers, schoolyard drug-dealers, thieving traitors-for-money, etc. They are punished more severely because of the intent and the special circumstances behind the crime. Hate-criminals have chosen to commit crimes solely, initially or primarily out of hate. If this motivation is not recognized by the law, then how are police and prosecutors to collect evidence and prepare cases? How are judges and juries to proceed? What criteria are they supposed to use to determine the type and severity of the crime, and of the punishment? The logic of the law and the imperatives of justice cannot allow for ambiguity. Without a law like this, justice cannot be done in cases like these, either from a legal, philosophical, moral or emotional point of view. You would be leaving the police and prosecutors without legal guidelines, and judges and juries without a lawful standard by which to judge. In order for our system of justice to work, tools like this new law are required.

Determining intent is a vital part of what the law is all about, and it's why we have a criminal justice system, and trial by juries. We trust juries to make these determinations as they make every other determination in the thousands of criminal cases across the country every day. The system is not perfect, but it is the best we have. If the right-tards don't get that, they don't get America. "With Liberty and Justice for ALL," it says in the Pledge of Allegiance that they themselves insist schoolchildren recite every day. Don't they mean it?

The victims and the perpetrators of crimes motivated by hatred and prejudice deserve justice. Now they will get it. This new law is long overdue, and it reaffirms a simple fact: We are one nation indivisible, where all men and women are created equal, and we demand that people be treated as such. This not Serbia or Rwanda, Nazi Germany or Stalinist Russia. The days of the Bund and the Klan are over. We are a great melting pot, and our diversity is our strength, always has been. Now we have a law to preserve, protect, ensure and defend that diversity. Let those who cannot abide it go somewhere else. Their hateful acts will no longer be tolerated, even though their hateful speech continues to be protected.

Rest easy, Republicans. We real Americans are not like you: We value, honor and uphold freedom & justice, in our deeds and not just in our words. Hate all you want, you sick bastards. But act on that hate, and we will bust you.

' Sec. 249. Hate crime acts

`(a) In General-

`(1) OFFENSES INVOLVING ACTUAL OR PERCEIVED RACE, COLOR, RELIGION, OR NATIONAL ORIGIN- Whoever, whether or not acting under color of law, willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived race, color, religion, or national origin of any person--

`(A) shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and

Yes, the Baltic precedents always rule, here. What would Latvia do, that is ALWAYS the question we Americans must ask ourselves.

' Ponder this, from the U.S. Constitution: No person except a natural born citizen [...] shall be eligible to the office of Presiden. Barack Obama was born in Hawaii. If you consider the history and believe that Hawaii is not legally a part of the United States, as many do, then one might ask, is Obama a natural born citizen of the United States? One could even make the argument that being born in Hawaii, he's a Hawaiian national! I believe the most compelling legal analysis based on Hawaiian kingdom and international law and precedent, is that the Hawaiian national population today is comprised of descendants of Hawaiian subjects and those foreigners who were born in the Hawaiian Islands prior to 1898. But it is a gray area that obviously hasn't been tested. In looking at the Baltic states as what I believe is the most apt comparison, Latvia and Estonia adopted this approach, with only descendants of citizens and persons born in the country prior to the occupation being citizens, while Lithuania adopted a more inclusive approach, providing those born in the country subsequent to the occupation with the option of citizenship as well. Could Obama have the option of becoming a Hawaiian national at some point in the future as the transition unfolds? '

' Lawmakers will pay tribute to service members who have died in the past year by awarding the Hawaii Medal of Honor. Since the medal was conceived in 2005, lawmakers have awarded 120 medals in 2007 and 67 last year to surviving spouses and family members. Takai, in a House floor speech earlier this month, said, "It has almost been five years since the war on terrorism began. While there continues to be much debate for and against this war, there is no debate about the tremendous sacrifices made by our service members and their families." He added, "In the past five years, the war against terrorism has changed our world and our lives in a profound way. Ultimately, it's not about politics, it's not about money and it's not even about winning. It's all about the families and their loved ones and what these brave men and women sacrificed to our country." Among the 19 families who will be present Tuesday will be Regina and Fabian Gagalac, whose son, Sgt. Alexander Gagalac, would have celebrated his 29th birthday on Friday. Gagalac was killed Sept. 9, 2007, just weeks before he was to return home. He died in Al Hawijah, Iraq, from injuries sustained from a rocket-propelled grenade while on a combat patrol. Gagalac, a Leilehua High School graduate, was assigned to the 2nd Battalion, 27th Regiment, 25th Infantry Division. He was serving his second combat tour in Iraq when he was killed. On Good Friday, nearly three dozen of the Gagalac family and the mother's side of the family gathered at his Punchbowl grave site to celebrate his birthday and that of this twin brother, Alexis. Both brothers were in Iraq at the same time in 2004 -- Alexander with the 25th Division and Alexis with the 1st Stryker Combat Brigade, sent from Fort Lewis, Wash. Alexis Gagalac left the Army and re-enlisted into the Hawaii Army National Guard and was assigned to Alpha Troop, 1st Squadron, 299th Cavalry. Regina Gagalac said the last time she saw her son Alexander was when he was home on leave last year and celebrated his 28th birthday. The death of his twin brother has also deeply affected Alexis Gagalac, who has left the Hawaii Army National Guard and will transfer to the Hawaii Air National Guard. He visits his brother's grave site every day, carefully tending to it as he did on Friday when he removed a small American flag because it was tattered and replaced it with a newer one. '

Captain Francis B. Wai distinguished himself by extraordinary heroism in action, on 20 October 1944, in Leyte, Philippine Islands. Captain Wai landed at Red Beach, Leyte, in the face of accurate, concentrated enemy fire from gun positions advantageously located in a palm grove bounded by submerged rice paddies. Finding the first four waves of American soldiers leaderless, disorganized, and pinned down on the open beach, he immediately assumed command. Issuing clear and concise orders, and disregarding heavy enemy machine gun and rifle fire, he began to move inland through the rice paddies without cover. The men, inspired by his cool demeanor and heroic example, rose from their positions and followed him. During the advance, Captain Wai repeatedly determined the locations of enemy strong points by deliberately exposing himself to draw their fire. In leading an assault upon the last remaining Japanese pillbox in the area, he was killed by its occupants. Captain Wai's courageous, aggressive leadership inspired the men, even after his death, to advance and destroy the enemy. His intrepid and determined efforts were largely responsible for the rapidity with which the initial beachhead was secured. Captain Wai's extraordinary heroism and devotion to duty are in keeping with the highest traditions of military service and reflect great credit on him, his unit, and the United States Army.

Pfc. Pililaau, a member of Company C, distinguished himself by conspicuous gallantry and outstanding courage above and beyond the call of duty in action against the enemy. The enemy sent wave after wave of fanatical troops against his platoon which held a key terrain feature on "Heartbreak Ridge." Valiantly defending its position, the unit repulsed each attack until ammunition became practically exhausted and it was ordered to withdraw to a new position. Voluntarily remaining behind to cover the withdrawal, Pfc. Pililaau fired his automatic weapon into the ranks of the assailants, threw all his grenades and, with ammunition exhausted, closed with the foe in hand-to-hand combat, courageously fighting with his trench knife and bare fists until finally overcome and mortally wounded. When the position was subsequently retaken, more than 40 enemy dead were counted in the area he had so valiantly defended. His heroic devotion to duty, indomitable fighting spirit, and gallant self-sacrifice reflect the highest credit upon himself, the infantry, and the U.S. Army. '

For conspicuous gallantry and intrepidity in action at the risk of his life above and beyond the call of duty. Cpl. Kawamura distinguished himself by heroic action while serving as a member of the 173d Engineer Company. An enemy demolition team infiltrated the unit quarters area and opened fire with automatic weapons. Disregarding the intense fire, Cpl. Kawamura ran for his weapon. At that moment, a violent explosion tore a hole in the roof and stunned the occupants of the room. Cpl. Kawamura jumped to his feet, secured his weapon and, as he ran toward the door to return the enemy fire, he observed that another explosive charge had been thrown through the hole in the roof to the floor. He immediately realized that 2 stunned fellow soldiers were in great peril and shouted a warning. Although in a position to escape, Cpl. Kawamura unhesitatingly wheeled around and threw himself on the charge. In completely disregarding his safety, Cpl. Kawamura prevented serious injury or death to several members of his unit. The extraordinary courage and selflessness displayed by Cpl. Kawamura are in the highest traditions of the military service and reflect great credit upon himself, his unit, and the U.S. Army. '

Revoke Racist Australian Nazi's Green Card, Divest Him Of All His U.S. Holdings

First of all, dump NewsCorp stock. Arrange to purge News Corp from all financial holdings and demand that all investment organizations do the same-- stock brokers, mutual funds, pension funds, IRA's, 401k's, trusts, college funds, university endowments, etc, cleansed of NewsCorp immediately. Hit them where it hurts, in their wallets. Hurt them bad. Shut them down.

When a foreign agent enters our country and attempts to sabotage our political system and bring down our government, it's time to act. Radical right-wing "businessman" Rupert Murdoch was flushed out of his native Australia years ago. He is no longer welcome in his next refuge, England, where he is regarded as an outright fascist and a life-long enemy of all democracy. He has been allowed to break, bend and bribe his way around anti-monopoly, anti-media consolidation, fairness and foreign-ownership laws and regulations for decades now in America. Successive Republican Administrations have kow-towed to this slimy foreigner for years.

His response has been to grab and exercise more and more power in the United States of America. After suffering a serious blow to his arch-conservative corporatist agenda in our first full, free and fair election in eight years, Murdoch has called the President of the United States a "chimpanzee" and called for his assassination. He belongs in Guantanamo Bay. His media empire must be broken up and dissolved immediately. His whole gang of America-hating crypto-fascists should follow him to prison forthwith.

Legitimate political discourse is one thing. Deliberate poisoning of that discourse is quite another thing. Murdoch's repeatedly calling for violent action by this country's already enflamed racists is criminal. Rupert Murdoch and NewsCorp have to go, now. Divest yourself of all holdings in NewsCorp, boycott their newspapers, magazines, radio and TV stations, TV & radio networks, movie studios and all their advertisers, sponsors, underwriters and investors. Demand that those who manage your money and entitlements do the same, or you will boycott them. Do it now. Please.
